Q: Is there value in leasing a space previously occupied by another office tenant?
A: Yes, in some instances. However, we advise having your advisory team review the property. There are multiple factors to consider including open versus closed office plans, IT requirements related to infrastructure, parking, and amenity space.
Q: Is it worth paying more rent to be in one location over another?
A: That depends on your requirements. Is a Plus-15 connection important? Is proximity to the C-train or a transit stop vital? Do you need a Class ‘A’ or ‘B’ Building? How important is underground parking or onsite amenities? Do you want to be in a LEED Certified building? There are many factors that might justify paying more. For example, the lowest rent deal is not always the best deal as the term may be shorter than a headlease and you are relying on the Sublandlord’s covenant. Once a Sublease expires, you may have to move or pay significantly higher rates.
Q: What sort of zoning issues may I run into?
A: Zoning could play a significant role in whether a space can work for you. In most cases, an office building is already zoned appropriately but an unconventional location or building type may require more investigation.
What’s important is getting on top of zoning issues upfront, during your planning stage. You’ll want to work with an experienced advisor to help you navigate zoning issues.
Q: What assistance can I expect from my new landlord in terms of free rent and tenant allowance?
A: There are no standard deals. The answer will depend on the location, the landlord, your use, and covenant. We’ll help set realistic expectations, based on what others are receiving.
Q: What is a covenant and am I always expected to provide a personal guarantee?
A: A covenant is the security you as a tenant provide. The Landlord relies on your financial well-being to give them the confidence to lease you space. A personal guarantee is not the only way to secure a covenant. You can often use a letter of credit, larger deposit, lower landlord contribution to the deal, etc.
